Terms of Use

1. Operator and service

SelectTake is operated by AJ GmbH, Danziger Str. 80, 65191 Wiesbaden, Germany, represented by Dr. Andreas Jahnke. SelectTake helps users privately store, organise, analyse, filter, and export their own image collections. These terms govern the use of the service, together with the Privacy Policy, Legal Notice, and the plan, price, allowance, and checkout information shown when you purchase a subscription.

2. Accounts and secure access

You need an account to use protected features. Creating an account requires acknowledgement of these Terms of Use and the Privacy Policy. Access is provided using a one-time passcode sent to your account email address. Keep that email account and your devices secure, do not share access, and contact us promptly if you suspect unauthorised use. You are responsible for activity carried out through your account where this is permitted by law. We may take proportionate steps to protect accounts and the service, including requiring a new sign-in, rate-limiting requests, or restricting access where there is a credible security or misuse concern.

3. Eligibility and acceptable use

You must be at least 16 years old, or have any parental or guardian permission required by applicable law. You may use SelectTake only for lawful private or authorised business purposes. Do not upload, request analysis of, or distribute content that is unlawful, infringes intellectual-property or privacy rights, exploits or endangers children, contains malware, facilitates surveillance or discrimination, or otherwise violates these terms. Do not attempt to bypass access controls, rate limits, plan allowances, security features, or use the service to benchmark, overload, reverse engineer, or interfere with it.

4. Your images and permissions

You retain your rights in the content you upload. You grant us the limited, non-exclusive permission needed to host, reproduce, create technical previews, process, analyse, organise, and export that content solely to operate the requested service for you. We do not use your uploaded images to train general-purpose models or improve a public recognition service without a separate lawful opt-in. You confirm that you have the rights, notices, and permissions required for these activities. Your images are private and are not made public or available to other users. SelectTake service functions need privileged technical access to create previews, perform the requested analysis, prepare exports, and delete content. Any exceptional platform-administrator access is restricted and governed by the Privacy Policy; it is not a user-facing browsing feature or ordinary manual review. This permission ends when the relevant content is deleted, subject to unavoidable backup, legal-retention, and security obligations described in the Privacy Policy.

5. Known people and face descriptors

Known-people matching is optional and is not required to upload, analyse, organise, or export images. You may add a reference only when you are the person shown or have that person’s explicit permission for this specific private-account matching purpose. The number of saved references is limited by plan: Free 2, Starter 5, Pro 10, and Scale 20. You must not use it for public identification, surveillance, employment, insurance, credit, housing, education, law enforcement, or other high-impact decisions. We may disable or remove the feature where necessary for law, safety, or a material privacy risk. Your separate consent and deletion controls are described in the Privacy Policy.

6. Analysis, duplicate indicators, and recommendations

SelectTake’s analysis, duplicate detection, quality signals, labels, and keep/review suggestions are assistive tools. They can be incomplete, delayed, or inaccurate and do not replace your review. In particular, a “duplicate” may be an exact duplicate or a visually similar image, and a “not duplicate” result is not a guarantee. You may optionally save explicit Keep, Review, and Delete choices for one collection to support that collection's review. After at least three choices, a small explainable scoring rule may refine suggestions in that collection for images without an explicit user choice, using already available blur, duplicate, and screenshot results; it does not run new image analysis or train a model. These choices are private to that collection, do not use face or sensitive-trait data, do not create an account-wide profile, can be reset, and never trigger automatic deletion. Do not rely on the service for medical, legal, safety-critical, identity, evidentiary, or other high-stakes decisions. You remain responsible for checking selections before deleting, sharing, printing, or otherwise using images.

7. Plans, allowances, payment, storage, and withdrawal

Available plans, prices, taxes, billing intervals, analysis allowances, and features are displayed at checkout. Usage allowances apply to completed analysis requests as described in the product and may be limited to prevent abuse. Each plan also has a total active-image and retained-byte capacity shown in Settings. When that capacity is reached, new uploads stop until you delete content or move to a plan with more capacity. Payment processing is provided by Stripe. You authorise applicable charges and are responsible for keeping billing details current. We may correct obvious pricing or technical errors before a purchase is completed, subject to mandatory law.

When activated, notified, and accepted for an existing account, the Free plan retains each image successfully uploaded on that plan for 60 days. If an account returns to Free after a paid period, images that remain stored in that account and are covered by the then-current Free-image policy are scheduled from that return to Free, including images originally uploaded during the paid period. An active paid plan pauses an already scheduled image’s timer. If fewer than 15 days remained when the paid plan began, we add 15 days to the paused time. When the account later returns to Free, the schedule resumes with that remaining time. This rule deletes images and their technical derivatives only, never your SelectTake account, Auth user, profile, or login. It does not apply to an existing account before activation, the required notice, and that account’s active acceptance of the updated Terms and Privacy Policy.

Paid subscriptions and their cancellation/renewal terms are available only when checkout is enabled. Where a paid subscription is offered, cancellation stops renewal at the end of the current paid period unless clearly stated otherwise. Any paid-cancellation content-retention grace period will be separately stated, notified, tested, and activated before it is enforced; it does not delete your SelectTake account. Deleting an account cancels an active subscription immediately; it does not erase statutory accounting records or automatically create a refund. Consumers can use the Right of withdrawal page and electronic withdrawal form. Where you expressly request immediate service provision, the applicable statutory withdrawal rules and any proportionate payment for service already supplied apply.

8. Exports and third-party services

You may download available exports for your own use. New uploads are retained and exported as optimised JPEG derivatives with a maximum dimension of 2048 pixels after their source files are temporarily processed, verified, and discarded. This may differ from the original source format, transparency, Live Photo motion component, original encoding, and original metadata. You are responsible for where you save, send, print, or share exported files. Any future connection to a photo-book provider or another third party will be optional and subject to that provider’s own terms, privacy information, prices, delivery conditions, and technical availability. SelectTake does not currently promise a direct transfer, commission arrangement, price, or fulfilment outcome with any photo-book provider.

9. Availability, changes, and support

We aim to operate the service reliably but do not guarantee uninterrupted availability, compatibility with every device or file type, or permanent retention outside the deletion and retention commitments in the Privacy Policy. Any upload or analysis duration shown in the service is a non-binding convenience estimate, not a promise or service-level commitment; it can vary with files, connection, device, queueing, and provider availability. We may maintain, update, change, suspend, or discontinue features where reasonable, while respecting mandatory consumer and contractual rights. We may provide notices through the service or by email where appropriate. Support requests can be sent through the contact details in the Legal Notice.

10. Content reports and enforcement

We do not pre-screen uploads. If we receive a sufficiently detailed report of allegedly unlawful content, we may investigate and take appropriate action, including restricting access, removing content where feasible, or suspending an account. Reports should identify the content or account, explain the concern, and include relevant evidence of authority. We will use proportionate measures and respect applicable procedural rights.

11. Liability

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for intent, gross negligence, injury to life, body, or health, product liability, or mandatory consumer rights. Subject to those limits and to applicable law, liability for slightly negligent breaches of non-essential obligations is excluded; for slightly negligent breaches of essential contractual obligations, liability is limited to foreseeable damage typical for this kind of contract.

12. Law, consumer rights, and changes

German law applies where lawful, without depriving consumers of mandatory protections in their country of habitual residence. We are neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board. We may update these terms for legal, security, operational, or service reasons, respecting any notice, consent, and termination rights required by law. If a provision is invalid, the remaining provisions remain effective to the extent permitted by law.
